OFFICIAL “CREATE A THX TRAILER” RULES
  1. DESCRIPTION OF CONTEST:

    The 2006 “Create a THX Trailer” (the “Contest”) is a promotion whereby directors, animators, creative THX fans, and avid movie goers (the “Entrant”) are invited to put their directing skills to the test and submit an original THX trailer, 25-60 seconds long using the THX Logo and THX Deep Note (“Trailer Submission”).

  2. HOW TO ENTER

    To enter, create a Trailer Submission 25-60 seconds long using the THX logo and THX Deep Note Audio file and complete a Submission Form available at www.thx.com (the “Submission Form”). Each entry consists of a Trailer and completed Submission Form (collectively, “Entry”). ALL ENTRANTS MUST COMPLETE, SIGN AND SEND A SUBMISSION FORM (ONE PER TRAILER).

    Send one (1) DVD or Digital Video copy of your Trailer Submission along with your completed Submission Form via regular mail to THX. All Trailer Entries, including Submission Forms must be received by 12:00 P. M. (NOON) Pacific Time on May 23, 2006.

    MAXIMUM OF ONE (1) ENTRY PER PERSON. ENTRIES WHICH ARE ILLEGIBLE OR WHICH DO NOT CONTAIN COMPLETE CONTACT INFORMATION (NAME, ADDRESS, ETC. OF ENTRANT) WILL BE DISREGARDED.

    Trailer Submissions will not be considered eligible contest entries until a corresponding Submission Form is received by THX. All Trailers (a) must be the original work of the person submitting the Trailer; (b) must be appropriate for general audiences; Trailer Submissions containing nudity, excessive swearing, explicit sexual themes and or graphic violence will be ineligible as a finalist; (c) may be live action, traditional animation, CGI, and or/Flash animation; (d) must be no longer than 60 seconds and; (e) must be cleared of all rights prior to being posted on the THX Web Site as set forth in the following paragraph. Each finalist will be required to sign a perpetual, exclusive, all rights, and distribution agreement or be disqualified.

    By submitting an Entry, you hereby (a) represent that you are the sole author and owner of your Trailer Submission, your Trailer Submission is under no restriction, contractual or otherwise, which will prevent THX’s use of the Trailer Submission or you from meeting your obligations hereunder, and that your Trailer Submission complies with the other requirements set forth in these Official Rules; (b) agree that the Trailer Submission shall be free of all liens, encumbrances and claims of third parties, including but not limited to obligations to guilds, unions, or performance rights organizations (e.g. ASCAP, BMI, SESAC or SOCAN); (c) acknowledge and agree that nothing in your Trailer Submission infringes on any copyrights or trademarks, or violates any person’s rights of privacy or publicity and that you have obtained all necessary releases and permissions; (d) grant THX a right to review such Trailer for the Contest and without additional consideration to the Entrant; and (e) agree to comply with these Official Rules, and Submission Form, and the Terms of Use on the THX Web Site. Decisions of THX regarding all aspects of the Contest are final and binding in all respects. Trailer Submissions deemed to be illegal or obscene, defamatory or offensive to a general audience (as described above) will be disqualified, in the sole discretion of THX. Trailer Submissions determined to infringe on any intellectual property rights or other rights will also be disqualified at the sole discretion of THX. All tangible submission materials become the property of THX and will not be returned. THX assumes no responsibility if, for any reason, your Entry cannot be viewed or is not capable of running as planned. THX is not responsible for any errors in Contest related materials, or lost, late, misdirected, damaged, incomplete, illegible or postage due Entries.

  3. ELIGIBILITY:

    This Contest is open to natural persons who are 13 years of age or older and are legal residents of the United States, Canada (excluding Quebec), and the United Kingdom. Entrants under the age of majority in their states of residence must supply written parental consent with their submission. All Winners will be required to execute an affidavit swearing to compliance with these eligibility requirements. Employees of THX and their respective parents, subsidiaries, affiliates, agencies and assigns, and their immediate family members (spouses and parents, children and siblings, and their spouses) as well as individuals living in the same households of such employees are ineligible. The Contest is subject to all applicable federal, state, local and provincial laws and regulations.

  4. SELECTION OF AWARD RECIPIENTS:

    Each Entry (and other terms herein) will be reviewed by an internal screening committee consisting of THX representatives. The entries will be screened based upon (1) originality; and (2) overall entertainment value.

    Entries that are approved by THX for consideration as finalists will receive further review from THX. Finalists will be selected on or immediately after June 23, 2006, after signing distribution contracts, affidavits of eligibility, liability releases and, where legal, publicity releases, with THX, their Trailer Submission will be posted on the THX Web Site. All finalists must sign the exclusive distribution contract as presented by THX; the terms are not subject to negotiation. Refusal to sign any of the above listed documents or otherwise satisfy all of the requirements herein will result in disqualification, and a replacement finalist may be selected in THX’s sole discretion. In addition, clearance of all rights must be documented to THX’s satisfaction sufficient to allow THX to use and distribute your Trailer Submission. Distribution contracts, master tapes or files, and other documents must be returned signed within the earlier of ten (10) days of notification of selection by THX or 12 P.M. Pacific Time on June 23, 2006.

    The Winners will be announced on or around June 23, 2006 and notified by email or certified or other trackable mail. All decisions of THX and the judges are final.

  5. AWARDS:

    Of the finalists, THX will select ten (10) winners (the “Winners”), each of whom will receive an authentic, exclusive THX Director’s Chair. (the “Award”). Trailer Submissions from the Winners will be displayed on THX’s Web Site for a limited time, with placement and duration to be determined by THX.

  6. CONDITIONS OF PARTICIPATION:

    In the event of non-compliance with these Official Rules, finalists will be disqualified and alternative finalists selected, at THX’s discretion. By entering, Entrants permit THX to use Entrant’s Trailer Submission in marketing/advertising materials without limitation. By entering, Entrants also agree to the use of their names and/or likeness for advertising and promotional purposes without additional compensation, unless prohibited by law. By entering, Entrants release and hold harmless THX and their parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with participation in this Contest or any Contest-related activities, or acceptance, possession, use and/or misuse of any award received herein.

  7. INTERNET DISCLAIMER:

    THX assumes no responsibility for technical, hardware or software failure of any kind for lost network connection or for garbled computer transmissions. If for any reason, the program is not capable of running as planned, including infection by computer virus, bugs, tampering, and unauthorized intervention, fraud, technical failures, or any other causes beyond the control of THX which corrupt or affect the administration, security, fairness or integrity of the Contest, THX reserves the right to cancel, terminate, modify or suspend the Contest and distribute awards from among all Entries received prior to action taken by THX. THX assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of Entries. THX is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, computer equipment, software, failure of any e-mail to be received by THX on account of technical problems, human error or traffic congestion on the internet or any web site, or any combination thereof, including any injury or damage to the participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this promotion.

    If for any reason your Entry cannot be viewed or is not capable or running as planned, including infection by computer viruses, bugs, tampering, unauthorized intervention, fraud or technical failures, THX assumes no responsibility. THX is not responsible for any problems or technical malfunctions.

  8. PUBLICATION OF AWARD RECIPIENTS:

    After the Contest has been concluded, the names of the Winners will be published on the THX Web Site at www.thx.com.
